Judge takes swipe at PCB for hiring Qayyum report ‘suspects’

KARACHI: Gulzar Ahmed, senior Judge of the Sindh High Court took a swipe at the Pakistan Cricket Board (PCB) during Danish Kaneria’s hearing lambasting the board for employing people who were reported as suspects in the Justice Malik Qayyum’s report, it was learnt by ‘The News’ on Friday.
Dr Mohammad Farough Naseem, the lawyer of Danish Kaneria who is trying be cleared for international duty, confirmed it. “The Judge asked PCB’s legal advisor Taffazzul Rizvi during the hearing why the PCB have appointed a person, who was named in Malik Qayyum’s report,” Naseem said.
According to the people present, the board’s legal advisor could not answer that query. But Rizvi said that they were just passing remarks and anyone can have their opinion. He added that those remarks had nothing to do with Kaneria’s case. Malik Qayyum’s report had suggested the name of Waqar Younis, who is currently the coach of the Pakistan team along with other players.
Although Juctice Qayyum wrote that there was no enough evidence against the player but he should be kept under observation. In addition, it said that: “Waqar Younis was reluctant to help the commission and even when he was prompted, was not fully forthcoming. It is therefore recommended that he be fined Rs100,000.”
It is not the first time that reservations have been raised over the appointment of Waqar Younis despite being named previously in fact-findings. It is important to mention that earlier this year, Akram Raza was also appointed on the PCB’s umpiring panel and was later caught with bookies that were fixing Indian Premier League (IPL) matches. Raza has denied any wrongdoing.
Meanwhile, it was reported in the media that Kaneria admitted that his British lawyer Stephen Haurigan has the transcripts and tapes of the investigation that the Essex police conducted on him last year. But the player has said that his Britain-based lawyer revived them on August 1. He added that Haurigan has said that they could not release them due to legal issues.
The SHC has adjourned the case until September 27 after the board asked Kaneria to produce tapes of the police inquiry he faced in the UK. The board’s legal advisor also revealed that he told the court that Kaneria can bring the tapes and can give it to the Judge if he is not willing to provide them to the PCB.
“I clearly said that if Kaneria doesn’t want the tapes to be given to the board then he can take them to the Judge who decides whether he is guilty or not,” Rizvi said.” Then whatever decision the court will take, we will accept it. It is astonishing that he is more interested in saving Westfield, instead of doing efforts to revive his career.”
It has been learnt that the board feels that there is something fishy in the case and that Haurigan is under Kaneria’s instructions since he has no right to hold onto the tapes.
In addition, the PCB is not impressed with the fact that the player is asking the board to make efforts to bring the tapes.
“It is the player who needs to get cleared, so he must do the efforts to produce sufficient efforts,” a source said. “Why would the board make efforts to get him cleared?
“If he can prove he is innocent, nobody would have problem in clearing him.”
